Agreement

These Terms of Service ("Terms") govern your access to and use of mobile apps, games, websites, and related services published by Dmitry Shurco, operating as shurco.app (collectively, the "Services").

By downloading, installing, accessing, or using any Service, you agree to these Terms. If you do not agree, do not use the Services.

The Services

Our Services include entertainment games, utility apps, and promotional websites. Features, supported platforms, and availability may change over time. Some Services are free; paid features or in-app purchases, if offered, will be disclosed before you are charged.

Information shown in our apps — such as fuel prices, opening hours, or map data — may come from official open-data sources or third parties. We work to keep it accurate and up to date, but we do not guarantee completeness, timeliness, or fitness for a particular purpose.

Eligibility

You must be old enough to form a binding contract in your jurisdiction to use the Services. If you are under the age required in your country, you may use the Services only with permission and supervision of a parent or legal guardian.

Acceptable use

You agree not to:

• Use the Services for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract source code except where permitted by law
• Interfere with or disrupt the Services, servers, or networks
• Use automated means to scrape or overload the Services without our written permission
• Impersonate others or misrepresent your affiliation with any person or entity
• Upload or transmit malware or harmful code

Intellectual property

The Services, including software, graphics, logos, text, and design, are owned by Dmitry Shurco or licensors and are protected by copyright, trademark, and other laws. These Terms do not grant you any ownership rights — only a limited, non-exclusive, non-transferable, revocable licence to use the Services for personal, non-commercial purposes in accordance with these Terms and applicable store rules.

Third-party platforms and links

Services distributed through Apple App Store, Google Play, Steam, or other platforms are also subject to those platforms' terms and policies. In case of conflict between platform terms and these Terms regarding billing, refunds, or platform-specific rules, the platform terms control for those matters.

The Services may link to third-party websites or apps (for example, map or navigation providers). We are not responsible for third-party content or practices.

Disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DMITRY SHURCO AND SHURCO.APP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE RELEVANT SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) EUR 50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold harmless Dmitry Shurco from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services or violation of these Terms, to the extent permitted by law.

Termination

You may stop using the Services at any time. We may suspend or discontinue any Service, or restrict access, if we reasonably believe you have violated these Terms or if required for legal, security, or operational reasons.

Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.

Governing law

These Terms are governed by the laws of Spain, without regard to conflict-of-law principles. Where mandatory consumer-protection rules in your country give you additional rights, those rights remain unaffected.

Courts in Barcelona, Spain shall have exclusive jurisdiction over disputes, except where applicable law requires otherwise for consumers.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. Material changes will be posted on this page. Continued use after changes take effect constitutes acceptance of the updated Terms.
