Agreement

These Terms of Service ("Terms") govern your access to and use of Promoter — the local-first launch console published by Dmitry Shurco, operating as shurco.app — including the Promoter desktop application, the promoter.shurco.app website, and related services (collectively, the "Promoter Services" or "Services").

By downloading, installing, accessing, or using Promoter, you agree to these Terms. If you do not agree, do not use Promoter.

The Services

Promoter helps independent creators and app makers publish original videos, announcements, and marketing copy to their own accounts on platforms such as TikTok (via Content Posting API Direct Post), YouTube, Instagram Reels, Facebook Reels, Reddit, dev.to, Hashnode, Mastodon, and Discord — through official platform APIs. Features, supported platforms, and availability may change over time. Promoter is currently offered without charge; paid features, if introduced later, will be disclosed before you are charged.

You are responsible for the content you create and publish through Promoter, and for complying with each third-party platform's terms when submitting through Promoter. In particular, when publishing to TikTok you agree to TikTok's Music Usage Confirmation and, when applicable, Branded Content Policy.

Eligibility

You must be old enough to form a binding contract in your jurisdiction to use Promoter. If you are under the age required in your country, you may use Promoter only with permission and supervision of a parent or legal guardian.

Acceptable use

When using Promoter, you agree not to:

• Use the Services for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract source code except where permitted by law
• Interfere with or disrupt the Services, servers, or networks
• Use automated means to scrape or overload the Services without our written permission
• Impersonate others or misrepresent your affiliation with any person or entity
• Upload or transmit malware or harmful code

Intellectual property

Promoter, including its software, graphics, logos, text, and design, is owned by Dmitry Shurco or licensors and is protected by copyright, trademark, and other laws. These Terms do not grant you any ownership rights — only a limited, non-exclusive, non-transferable, revocable licence to use Promoter for personal or internal business purposes in accordance with these Terms and applicable platform rules.

Third-party platforms and links

Promoter integrates with third-party platforms such as Reddit, dev.to, Hashnode, Mastodon, Discord, TikTok, and AI providers. Your use of those platforms through Promoter is also subject to their terms and policies.

Promoter or promoter.shurco.app may link to third-party websites or apps. We are not responsible for third-party content or practices.

Disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DMITRY SHURCO AND SHURCO.APP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF Promoter.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO Promoter SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR Promoter IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) EUR 50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold harmless Dmitry Shurco from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of Promoter or violation of these Terms, to the extent permitted by law.

Termination

You may stop using Promoter at any time. We may suspend or discontinue Promoter, or restrict access, if we reasonably believe you have violated these Terms or if required for legal, security, or operational reasons.

Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.

Governing law

These Terms are governed by the laws of Spain, without regard to conflict-of-law principles. Where mandatory consumer-protection rules in your country give you additional rights, those rights remain unaffected.

Courts in Barcelona, Spain shall have exclusive jurisdiction over disputes, except where applicable law requires otherwise for consumers.

Changes to these Terms

We may update these Terms for Promoter from time to time. The "Last updated" date at the top reflects the latest revision. Material changes will be posted on this page. Continued use of Promoter after changes take effect constitutes acceptance of the updated Terms.
